Arkansas Child Abuse Laws

Act 749 of 2009, codified at Ark. Code. Ann. §12-18-101 et seq., effective July 31, 2009.

This year, Arkansas enacted a new Child Maltreatment/Abuse statute, thus repealing the previous statutes on child abuse in Arkansas (Ark. Code Ann. §12-12-501 et seq.).

It's a lot more complex than the original act, but honestly, it is the same language and meaning of the original statutes in a whole-new chapter with a more in-depth approach.

FDCPA -- Fair Debt Collections my foot

I am this close to screaming at the top of my lungs. Arkansas recently passed its own FDCPA (Act 1455 of 2009, codified at Ark. Code Ann. §17-24-501 et seq., passed in April 2009) that is substantially similar to the federal FDCPA. But why?

Under 15 U.S.C. §1692o,

"The Commission shall by regulation exempt from the requirements of this subchapter any class of debt collection practices within any State if the Commission determines that under the law of that State that class of debt collection practices is subject to requirements substantially similar to those imposed by this subchapter, and that there is adequate provision for enforcement."

In addition, this is the only provision of the FDCPA that has federal regulations, 16 C.F.R. §901 et seq(found at http://ecfr.gpoaccess.gov/cgi/t/text/text-idxc=ecfr;sid=2f1072eb816390ab3d1167ea802767d7;rgn=div5;view=text;node=16%3A1.0.1.9.85;idno=16;cc=ecfr ). What do the regulations say??

"Any State may apply to the Commission pursuant to the terms of this Rule for a determination that, under the laws of that State,1 any class of debt collection practices2 within that State is subject to requirements that are substantially similar to, or provide greater protection for consumers than, those imposed under sections 803 through 812 of the Act, and that there is adequate provision for State enforcement of such requirements. The application shall be in writing, addressed to the Commission, signed by the Governor, Attorney General or State official having primary enforcement or responsibility under the State law which is applicable to the class of debt collection practices, and shall be supported by the documents specified herein.

1 Any reference to State law herein includes a reference to any regulations that implement State law and formal interpretations thereof by a court of competent jurisdiction or duly authorized agency of that State.

2 As applicable, references to “class of debt collection practices” in this rule include one or more such classes of debt collection practices."

"The Commission will consider the criteria set forth below, and any other relevant information, in determining whether the law of a State is substantially similar to, or provides greater protection to consumers than, the provisions of sections 803 through 812 of the Act regarding the class of debt collection practices within that State, and whether there is adequate provision for State enforcement of such law. In making that determination, the Commission primarily will consider each provision of the State law in comparison with each corresponding provision in sections 803 through 812 of the Act, and not the State law as a whole in comparison with the Act as a whole.

(a) In order for provisions of State law to be substantially similar to, or provide greater protection to consumers than the provisions of sections 803 through 812 of the Act, the provisions of State law3 at least shall provide that:

3 This subsection is not be construed as indicating that the Commission would consider adversely any additional requirements of State law that are not inconsistent with the purpose of the Act or the requirements imposed under sections 803 through 812 of the Act.

(1) Definitions and rules of construction, as applicable, import the same meaning and have the same application as those prescribed by sections 803 through 812 of the Act.

(2) Debt collectors provide all of the applicable notifications required by the provisions of sections 803 through 812 of the Act, with the content and in the terminology, form, and time periods prescribed by this part pursuant to sections 803 through 812; however, required references to State law may be substituted for the references to Federal law required in this part. Notification requirements under State law in additional circumstances or with additional detail that do not frustrate any of the purposes of the Act may be determined by the Commission to be consistent with sections 803 through 812 of the Act;

(3) Debt Collectors take all affirmative actions and abide by obligations substantially similar to, or more extensive than, those prescribed by sections 803 through 812 of the Act under substantially similar or more stringent conditions and within the same or more stringent time periods as are prescribed in sections 803 through 812 of the Act;

(4) Debt Collectors abide by the same or more stringent prohibitions as are prescribed by sections 803 through 812 of the act;

(5) Obligations or responsibilities imposed on consumers are no more costly, lengthy, or burdensome relative to consumers exercising any of the rights or gaining the benefits of the protections provided in the State law than corresponding obligations or responsibilities imposed on consumers in sections 803 through 812 of the act.

(6) Consumers' rights and protections are substantially similar to, or more favorable than, those provided by sections 803 through 812 of the Act under conditions or within time periods that are substantially similar to, or more favorable to consumers than, those prescribed by sections 803 through 812 of the Act.

(b) In determining whether provisions for enforcement of the State law referred to in §901.3(a) are adequate, consideration will be given to the extent to which, under State law, provision is made for administrative enforcement, including necessary facilities, personnel, and funding."

The FTC Commission has not mentioned anything about Arkansas being exempt in the Federal Register. So ... I get to scream at Arkansas for making today more complex than it needed to be, right?

While writing a section pertaining to GINA (the Genetic Information Nondiscrimination Act of 2008), I realized that I wasn't sure if I should say ... "GINA affects the health insurers and employers ..." or "GINA effects ...".

Update of the Week

Today is Wednesday ... I think.

Last week was hideous. I didn't take my Allerga, because it's expensive and I don't need it in the summer. But not taking the Allerga in the fall causes intense headaches which then lead to me missing both work and class. :(

I dropped one of the 3 graduate classes that I was taking. Media Ethics was a seminar class with both undergraduates and graduates. I was the only one with an opinion that differed from the bubble-headed, blonde, cheerleading bimbos. So, of course, I was the hostile one. The class was just too much stress to deal with.

I love working at my job (thought I wish that I wasn't so exhausted with classes and life, so that I could get here earlier). I worked 10 hours this past weekend on an Appellee Brief. I worked on the weekend!! And parts of my writing were actually used in the Brief!!

Zach is on vacation and has been for the past two weeks. I'm kinda glad that he is, but I wish that he would get a new car. He will be going back to work soon and I can't drive him to and from work all the time. It is very exhausting especially since we are on different time schedules (Me at 9 to 5 or 8 while He is 1:30 to 11 pm). His car is beyond repair and he has been talking about getting a standard transmission Cavalier from Joel's younger brother. I just wish the situation was resolved so that I wouldn't worry. ~~~ Overall, it has been wonderful with him on vacation; I can actually see him!!

Yesterday, we got to be in a commerical for a Greek restaurant in Little Rock - Taziki's - and we got free food because of it.

... I can't think ... of anything else to write ....

Bri's Kitty Earflap Hat

I joined Ravelry.com and have been enjoying my knitting projects alot more!!

So ... I decided to try the blog posting thing on there and post about my latest project. Bri (one of Zach's roommates) wanted a gothic kitty earflap hat like the one that I made for Lesley (Zach's other roommate). Bri wanted the hat black with burgundy inside the ears and for the ribbons.

I started the hat a few days ago and I am utterly disgusted with myself. I haven't frogged an earflap hat in years ... I haven't twisted the hat when joining circularly in forever. But yes ... I did it. :( I had to frog the first two rows that I had done and untwist the project and start again.

But now the hat isn't twisted and one day, it will be wearable.

The Perfect Dress

I watched Bride Wars. I liked it. And then I had to go look at Vera Wang wedding dresses .... :(

I don't know what the deal is with movies about weddings/getting married. After watching them, I always feel compelled to go search for that perfect wedding dress. As I search and download white ball gown after white ball gown ... I am quietly condemning myself.

I am not ready to get married. I do not want to be one of those girls that finds the dress and then spends forever finding the right guy. I want to find the guy ... and have him propose before I find that perfect dress to walk down the aisle.

And yet ... every time I watch a romantic comedy about weddings ... I find myself searching and scrolling through a taffeta kaleidoscope of white, blush, and peach. A-line or Mermaid cut, Heart-Shaped or Scoop, Off the Shoulders or Strapless .... it's all a white nightmare of torture. I'm physically searching for that perfect white dress while inside myself, I am grimacing and wondering why I elect to inflict this torture upon myself.

I have a wonderful boyfriend. We haven't even been dating a year. I'm happy and would love to one day think about marriage to him ... but in reality, I'm not ready just yet to be married or to think about marriage. I do not want to be buried in a taffeta, lace, and satin delusion of happiness that may never be ...
